Information We Collect Directly From You:

Additional Utilities

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. How We Use Your Information:

We use Personally Identifiable Information and other information as described herein including for the following purposes:

    • to contact you about and provide you with our Services,

Non-Personally Identifiable Information:

As noted above, we may collect information that is not Personally Identifiable Information (“Non-Personally Identifiable Information”).  We may aggregate or de-identify Personally Identifiable Information so that the information does not personally identify you or anyone else, such as by using Personally Identifiable Information to calculate the percentage of our customers who live in a particular area.  Because Non-Personally Identifiable Information, including aggregate or de-identified information, does not personally identify you, we may collect, use and disclose Non-Personally Identifiable Information for any purpose permitted by law and subject to the section titled “California Consumer Notice”.  In some instances, we may combine Non-Personally Identifiable Information with Personally Identifiable Information.  If we combine any Non-Personally Identifiable Information with Personally Identifiable Information, the combined information will be treated by us as Personally Identifiable Information.

How We Share Your Information:

Besides using your Personally Identifiable Information ourselves, we may send your Personally Identifiable Information and other information to other companies, affiliates and third parties in the following instances:

      improve and enhance your experience using the Website and Services and for our

Security:

Data Retention:

We will retain your information for as long as your account or inquiry is active or as needed to provide you with the Website or Services and for a reasonable time thereafter in accordance with our standard procedures or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Protection for Children:

Our Website and Services are intended for ages 18 and over. We do not knowingly collect Personally Identifiable Information from minors.  When we become aware that Personally Identifiable Information (or other information that is protected under applicable law) from a child under 13 (or such other age as may be restricted under local law) has been collected, we will use all reasonable efforts to delete such information from our database. Opt-Out:

To opt-out of any
future promotional messages from us, you should send an unsubscribe request to

receipt.  Please note that if you opt out
in this manner, certain aspects of the Website or Services may no longer be

California Consumer Notice:

We collect
information (some of which may also constitute Personally Identifiable
Information) that identifies, relates to, describes, references, or is
reasonably capable of being associated with, or could reasonably be linked,
directly or indirectly, with a particular consumer or household. The California
Consumer Privacy Act of 2018 (“CCPA”) refers to such information as “personal

business purpose during the prior 12 months, and will do so in the future.  California consumers may access, delete and
control certain uses of their information as set forth in Rights to Your Information.

Sharing of Personal Information:

Pearl Media may disclose your personal information to a third party for a business purpose.  The CCPA defines “sell” much broader than what you would intuitively expect, and includes releasing, disclosing, disseminating, making available, transferring the personal information for monetary or other valuable consideration. We do not “sell” your personal information, as that term is defined under the CCPA.

Rights to Your Information:

Right to Know About Personal Information Collected, Disclosed or Sold

As a California consumer, you have the right to request that we disclose certain information to you about our collection, use, disclosure or sale of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access and Deletion Rights), and subject to certain limitations that we describe below, we will disclose such information. You have the right to request any or all of the following:

    • The categories of personal
      information we collected about you.

    • The categories of sources from
      which the personal information is collected.

    • Our business or commercial
      purpose for collecting or selling that personal information.

    • The categories of third
      parties with whom we share that personal information.

    • The specific pieces of
      personal information we collected about you (also called a data portability

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.  However, we maybe retain personal information that has been de-identified or aggregated. Furthermore, we may deny your deletion request if retaining the information is necessary for us or our service provider(s) in order to perform certain actions set forth under CCPA, such as detecting security incidents and protecting against fraudulent or illegal activity.

Only you, or a person or business entity registered with the California
Secretary of State that you authorize to act on your behalf (an “authorized
agent”), may make the requests set forth above.

The request should include your contact information and describe your
request with sufficient detail that allows us to properly understand, evaluate,
and respond to it. In addition, you should provide sufficient information that
allows us to reasonably verify that you are the person about whom we collected
the personal information or an authorized representative of that person.

Response Timing and Format

We will respond to consumer requests in a
reasonably timely manner. If we require extra time to respond, we will inform
you of the reason and extension period in writing. In order to protect the
security of your personal information, we will not honor a request if we cannot
verify your identity or authority to make the request and confirm the personal
information relates to you. The method used to verify your identity will depend
on the type, sensitivity and value of the information, including the risk of
harm to you posed by any authorized access or deletion. Generally speaking,
verification will be performed by matching the identifying information provided
by you to the personal information that we already have.

Any disclosures we provide will only cover the 12-month period preceding
our receipt of your request (and will not be made more than twice in a 12-month
period). If we cannot comply with a request, or cannot fully comply with a
request, the response we provide will also explain the reasons we cannot
comply.

We will not discriminate against you for exercising any of your CCPA
rights.

Nevada Privacy Rights:

If you are a Nevada resident, you have the right to request that we do not sell your covered information (as those terms are defined in N.R.S. 603A) that we have collected, or may collect, from you.  We do not sell your covered information, however, if you would like to make such a request you may do so by contacting us at privacy@pearlmedia.com.
